SCRANTON -- A part-time Carbondale police officer charged with homicide is scheduled to be in court on Tuesday.

Tuesday is the preliminary hearing for Frank Schulze.

The case divided a community, and it's about to go before a district justice.

According to arrest papers, Frank Schulze heard loud voices outside his Carbondale apartment back in February, then went outside to investigate.  The incident outside escalated and ended with Schulze shooting and killing Joseph Molinaro of Fell Township.

The District Attorney's investigation took nearly two months. Shulze was charge with homicide in late March. The DA said there was no evidence the shooting was justified.

Schulze's attorney strongly disagreed, saying Schulze is innocent, shooting to protect himself and his family.

A district justice doesn't have to decide guilt or innocence. At the close of the hearing, the justice will decide if there is enough evidence to send Schulze to trial.
