COURTDALE -- A family is dealing with the death of a 16-month-old little boy after his father hit and killed the little boy with the SUV he was driving Monday morning.

While there is some suspicion about whether the father was under the influence, the family is adamant it was nothing but a freak accident.

16-month-old Michael Nice Jr. died early Monday morning. Police took the boy's father immediately into custody after the crash for a blood test to check if he was under the influence.

The young child's mother spoke with Newswatch 16 and says this is a nightmare. She is mourning the death of her son and has to deal with a community now judging her family.

Nicole Gerow, Michael's mother, said it all happened so fast.

"It was kids loving their father, giving a kiss and a hug, and he wanted another one and he darted over and he hit the car," she said.

The family has placed a candle and flowers on the spot in their driveway where they say Michael Nice Jr. was hit.

In another part of the driveway, his 5-year-old brother Anthony and 3-year-old sister Carmen lined flowers in a circle as a memorial to their baby brother.

"It was a complete accident. Instead of saying horrible things or bad things, support us. This is what we need at this time."

The family says they have been ridiculed and judged by some people in the community after the boy's father, Michael Nice Sr. was put in handcuffs and taken away from the scene while police investigated.

State police impounded his SUV and took him in for a blood alcohol test, but the family is adamant that he was not impaired in any way during the time of this accident.

"He was not intoxicated. He was not under the influence of anything. It was 8 o'clock in the morning and he was going to work 16 hours today. He had just woke up."

The family says they hope the results from Michael Nice Sr.'s blood test come back soon so that they can move past this suspicion and focus on mourning the death of their little boy.

State police have not said when those test results will be made available.
