WILKES-BARRE -- Days after assault charges were withdrawn against a Wilkes-Barre police officer, Mayor Tom Leighton says Sgt. Al Rodriguez has retired.

Rodriguez was charged last month for an incident at his home, but the district attorney's office says charges were withdrawn because the alleged victim did not show up at court.

Officials confirm that Rodriguez was the officer caught on cell phone video in November arguing with a family during a traffic stop in Wilkes-Barre. The Wilkes-Barre police department investigated that incident, but Rodriguez was never disciplined.
