A 10-year-old boy charged with criminal homicide is scheduled to have a hearing on Monday to determine if he should be treated as a juvenile.
Tristin Kurilla is charged as an adult for killing an elderly woman at his grandfather's home north of Honesdale last year.
His attorney is asking a judge to decertify the case, which would move it to juvenile court.
The judge may also decide whether Kurilla should be moved to a mental health facility instead of the Wayne County prison where the fifth grader has been held since October.
