BLACK CREEK TOWNSHIP - State police said snowy roads could be what led to a crash on interstate 80 in Luzerne County.

Police believe a the driver of a tractor trailer tried to slowdown when he saw state police on the side of the highway.

Instead, the trailer jackknifed and hit the cruiser, which then hit a car that was already on the side of the road and that car hit a state trooper.

Trooper Daniel Spath was struck in the legs and thrown over the guide rail.

Sgt. David Peters with State Police said, "He was treated and released, he's doing ok. But in other circumstances that might not be the case. "

Police said crashes like this are the reason why the "Steer Clear" Law is on the books.

The law makes drivers move into another lane of traffic when police, construction or even tow trucks are on the side of the road.

If you don't obey the law, you can face a fine up to $250.

PennDOT is even reminding drivers with signs along state roads.

State police said that steer clear law is in effect even when driving conditions are bad. They said, in those instances, you should slow down if you can't get into the other land and approach the scene at a cautious speed.

"You're asked to bring your vehicle down to a speed that's controllable and reasonable," saig Sgt. Peters.

State police said it can be difficult to catch drivers who disobey the law, because police are often tied up dealing with the emergency.

Drivers said it is hard to always remember to slow down, especially when driving in the snow.

But they also say that steer clear law can help keep everyone safe.

"Those officers are out there to protect us. They need to protect themselves too," said Jim Lacey from Binghamton, NY.

Frank Barnard from Belgrade, Maine said, "Just slow down and be cautious about what you're doing. "

Police said the driver of the tractor trailer will not be cited for the crash because he did try to slow down

However, police said he will most likely be responsible through insurance for a new cruiser which can cost about $50,000.
