HONESDALE -- The state attorney general's office will be taking over the case of the 10-year-old boy charged with homicide in Wayne County.
Authorities say Tristen Kurilla killed a 90-year-old woman on Saturday at his grandfather's home near Damascus by holding a cane to her throat and punching her several times.
The state is taking over the case because of a conflict of interest in the Wayne County D.A.'s office.
The boy's attorney is now trying to have the case moved from adult to juvenile court.
