SCRANTON -- Police have filed charges in Lackawanna County against the driver in a crash that killed a 12-year-old boy.
The boy was a passenger in a car that collided with a sport utility vehicle on Labor Day weekend in Old Forge.
He and his father were going for ice cream. Neither one returned home. The boy was killed and the father was rushed to a hospital.
On Thursday, the other driver was charged with causing the wreck.
Old Forge police arrested David Turano at his home in Carbondale.
Turano is charged with homicide by vehicle while driving under the influence for that August 30 crash that killed a 12-year-old boy.
Turano was brought to the Lackawanna County district attorney's office in Scranton after his arrest
Police say that over the Labor Day weekend, Turano was the driver of the SUV that crashed into the car Lenny Zupon Jr. was riding in. Zupon later died.
His father was seriously injured.
Old Forge police say Turano had been drinking before the crash on South Keyser Avenue and his blood alcohol content was .118.
According to court papers, Turano told police he didn't know why he ran from the crash scene and that he was scared.
"It doesn't just affect a small circle. It affects a large vast number of people. People's lives are forever changed by one person making a poor decision," said Lackawanna County Assistant District Attorney Robert Klein.
The assistant D.A. also told Newswatch 16 that the case against Turano falls under the newly implemented Kevin's Law. It's named for a young boy from Luzerne County who was killed in a hit and run.
Kevin's Law increases the mandatory minimum sentence for drivers who leave the scene of a deadly crash.
The assistant D.A. says if Turano is convicted of fleeing the scene, he could be the first case where that increased sentence would apply.
Turano is locked up with bail set at $200,000.
