WILKES-BARRE -- Testimony was supposed to begin Tuesday morning at the trial of a woman accused of killing her boyfriend, but there's been a delay.

After hours of legal back-and-forth, prosecutors said they needed to appeal a judge's ruling about evidence involving Jessica Alinsky allegedly staging a previous burglary at their shared home, unrelated to the shooting.

The trial was delayed indefinitely.

Alinsky was sent back to the Luzerne County Jail.

The jury that was selected Monday and was told that the trial would last more than a week was dismissed.

A new jury will need to be selected if this case goes to trial.

There is no word on the next court date.

It's a case that started as a suicide then later was ruled a homicide.

Next the victim's girlfriend pleaded guilty but then changed her mind.

Jessica Alinsky didn't answer any of our questions as she was led to an elevator this morning.

Last year, jurors in a coroner's inquest ruled that case looked more like a murder than a suicide.

Alinsky is accused of shooting and killing her boyfriend Matthew Gailie in 2011.

It happened in the Eagle Rock gated community near Hazleton.

At first, police thought he may have taken his own life.

Jessica Alinsky pleaded guilty to third degree murder in April and then changed her mind the next month.

Alinsky now faces first degree murder charges.
