WILKES-BARRE -- Attempted homicide charges have been withdrawn against a man in Luzerne County.
The lawyer for James Whiteside, 27, of Wilkes-Barre said a judge withdrew the charges Monday because the district attorney's office could not find a witness that was supposed to testify at trial in July.
Whiteside had been locked up since July 2013 when police say he pointed a gun at a man's head and pulled the trigger, but the gun did not fire.
Whiteside has been released from jail.
