A federal judge has agreed to dismiss a fraud charge against a man accused of scamming investors out of millions of dollars.
The judge also ruled Anthony Lupas be released from a federal facility in North Carolina.
Lupas was there undergoing mental evaluations.
Last year, a judge ruled Lupas, who is in his late 70s, was not mentally competent to stand trial.
