Judge Scolds Father For Son’s Injuries

PORT CARBON -- Nearly a year after an ATV crash that seriously injured a 2-year-old boy, the child's father was in court to face child endangerment charges.

The district magistrate hearing the case in Schuylkill County scolded the father, Kyle Delpais, for the crash.

The magistrate said the man from Brockton disregarded all risk last year when he took his 2-year-old son Bryce for a ride on an ATV.

Testimony from the child's mother said the crash on the ATV caused Bryce to have a stroke. He lost movement in his left hand and has speech problems.

Defense Attorney Fred Fanelli said his client made a mistake.

"People make mistakes and unfortunately people get hurt and this is a lesson to all of us. This is a father who very much loves his son, never wanted this to happen."

Assistant District Attorney Robert Reedy said the case is more than a parent using poor judgement.

"This is a case of a parent who wants to be a friend with the child and, not being a responsible adult, rode with their ATVs."

The magistrate ruled there is enough evidence to try Delpais on charges of reckless endangerment and endangering the welfare of children.

Delpais is free on bail. Bryce's family says the child faces a long road to recovery.
