Police in the Poconos say they now have the man responsible for the death of a retired school teacher in their custody.

Rico Herbert was finally brought back to Monroe County Monday night from South Carolina where he was caught back in February.

Herbert was arraigned at a district judge’s office in Coolbaugh Township around 10:30 p.m. Monday, on numerous charges, including criminal homicide in connection to the death of Joseph Devivo, 87, a retired school teacher.

Police accuse Herbert of killing Devivo during a burglary at Devivo's Stroud Township home in February.

Police then say Herbert put Devivo's body in the trunk of Devivo's car and drove to South Carolina, where he dumped the body.

Police in Monroe County were contact on February 25 by a family member of Devivo, who said he was last seen at his home on February 23.

When police went to his home, they found his car, cell phone and wallet missing.

Later that day investigators in South Carolina picked up Herbert who they say was driving Devivo's car and had Devivo's wallet.

He's been locked up in South Carolina since then on charges of receiving stolen property.

In interviews with Stroud Area Regional police, investigators say Herbert admitted to being in Devivo’s home on several occasions, including the day Devivo went missing.

Along with criminal homicide Herbert also faces charges of theft by unlawful taking, robbery of a motor vehicle, burglary and abuse of a corpse.

Investigators say Herbert and Devivo did know each other but would not say how.

Herbert is scheduled for a preliminary hearing on April 27.
